These Terms and Conditions (“Terms”) regulate your access to
and use of services offered through https://www.mygenie.in
and associated mobile or digital applications (collectively, the “Platform”).
The Platform, together with all services made available through it, is referred
to as the “Services.”
These Terms incorporate by reference our Privacy Policy and
any additional guidelines, policies, or service-specific conditions that may be
published from time to time (“Additional Policies”). In case of any
inconsistency, the Additional Policies applicable to a specific service shall
take precedence.
These Terms form a legally binding agreement between MyGenie (or relevant operating entity) (“MyGenie”,
“we”, “our”, or “us”) and you (“User”, “you”, or “Customer”). By accessing or
using the Platform, you confirm that you have the legal capacity to enter into
this agreement and agree to comply with these Terms. If you do not agree, you
must not use the Services.
1. Scope of Services
(a) MyGenie operates a technology platform that enables
users to discover, request, and schedule a range of services provided by
independent third-party professionals (“Service Providers”).
(b) The actual services delivered by Service Providers
(“Partner Services”) are outside the direct control of MyGenie. We act solely
as an intermediary facilitating connections and payments.
(c) Service Providers are independent entities and are not
employees, agents, or representatives of MyGenie.
(d) The Platform is intended for personal use unless
otherwise agreed in writing.
2. User Registration and Account
(a) To access certain features, you must create an account
and provide accurate information, including your mobile number or email.
(b) You must be at least 18 years old to register.
(c) You are responsible for safeguarding your login
credentials and for all activities conducted under your account.
(d) MyGenie is not liable for any unauthorized use of your
account.
3. Bookings and Service Requests
(a) Users may request services by selecting available time
slots and providing relevant details.
(b) A booking is confirmed only after acknowledgment via
SMS, email, or in-app notification.
(c) MyGenie may reschedule or suggest alternatives if a
Service Provider is unavailable.
(d) Service Providers reserve the right to decline a request
under reasonable circumstances.
4. Pricing and Payments
(a) Prices displayed on the Platform are indicative and may
vary depending on the scope of work, materials, or additional requirements.
(b) Payments may include:
- Service
charges payable to Service Providers
- Platform
or convenience fees payable to MyGenie
(c) Payments can be made via online methods (UPI, cards,
wallets) or other available options.
(d) All payments are final unless otherwise specified or
required under applicable law.
(e) Applicable taxes will be charged as per Indian
regulations.
5. Cancellations and Refunds
(a) Users may cancel bookings subject to applicable
cancellation charges.
(b) Refunds, if applicable, will be processed based on the
specific service terms.
(c) Repeated cancellations or misuse may lead to account
suspension.
6. User Conduct
You agree that you will:
- Treat
Service Providers respectfully and without discrimination
- Provide
a safe and appropriate environment for service delivery
- Not
engage in abusive, unlawful, or fraudulent behavior
MyGenie reserves the right to restrict or terminate access
for violations of these standards.
7. User-Generated Content
(a) You may submit reviews, feedback, or other content
(“User Content”).
(b) By submitting content, you grant MyGenie a perpetual,
royalty-free license to use, reproduce, and display such content.
(c) You are responsible for ensuring that your content is
lawful and does not infringe third-party rights.
(d) MyGenie may remove content at its discretion.
8. Data and Privacy
(a) Your personal data will be handled in accordance with
our Privacy Policy.
(b) You consent to the collection, use, and sharing of your
data with Service Providers and partners as necessary to deliver Services.
(c) We may disclose information if required by law or
regulatory authorities.
9. Third-Party Services
The Platform may include links or integrations with
third-party services. MyGenie is not responsible for their content,
performance, or policies. Your use of such services is at your own risk.
10. Intellectual Property
All content, branding, and technology on the Platform are
owned by or licensed to MyGenie. You are granted a limited, non-transferable
license to use the Platform for personal purposes only.
11. Disclaimers
(a) The Platform is provided on an “as available” and “as
is” basis.
(b) MyGenie does not guarantee:
- The
quality, reliability, or suitability of Service Providers
- Continuous
or error-free operation of the Platform
(c) Any agreement for Partner Services is strictly between
you and the Service Provider.
12. Limitation of Liability
To the fullest extent permitted by law:
- MyGenie
shall not be liable for indirect, incidental, or consequential damages
- Our
total liability shall not exceed the amount paid for the relevant service
or INR 10,000, whichever is lower
13. Indemnification
You agree to indemnify and hold MyGenie harmless against
claims, damages, or losses arising from:
- Your
misuse of the Platform
- Breach
of these Terms
- Violation
of any laws or third-party rights
14. Termination
(a) MyGenie may suspend or terminate your account if:
- You
violate these Terms
- Required
by law
- For
operational or security reasons
(b) You may stop using the Services at any time.
(c) Certain provisions will survive termination, including
liability and indemnity clauses.
